pilot issues

litigation related to pilot actions

As a former Navy pilot with fourteen years of military piloting experience, Mr. Ditchey is well qualified to act an an Expert Witness in aviation litigation involving pilot issues.  Additionally, Mr. Ditchey was the Senior Vice President at two different major airlines, responsible for all aspects of pilot hiring, training, and performance.  Examples of Mr. Ditchey's Expert Witness, experience include:
  • Three cases involving the wrongful termination of pilots involving corporate jet aircraft in Part 135 companies.  In one case, Mr. Ditchey testified at trial in support of the pilot, who subsequently won a multi-million-dollar award.
  • Mr. Ditchey testified at trial in support of the famous pilot Darrell Greenameyer, who was sued for negligence in the total loss of a B-29 aircraft in Greenland.  Except for a minor aspect, Mr. Greenameyer won the case.
  • One case involved a posthumous claim of negligence against a pilot, which Mr. Ditchey subsequently established was a maintenance issue.
  • Other Expert Witness cases involved a mix of causation wherein both pilot error and maintenance error was involved, and some involved manufacturing and design error as well.

In almost all aircraft accidents involving damage to or loss of the aircraft, pilot issues are somehow involved, albeit not the sole or even the major cause.

The management of pilot training is one of the most important and costly aspects of flight operations management at an airline, other than salaries.

Human factors will always be a major part of aviation accidents and incidents, and thus a major part of aviation litigation.
